Texas Domestic Violence Laws

In recent years, Texas has focused on strengthening domestic violence laws. These laws are designed to protect victims from various forms of abuse.

According to Texas law, domestic violence occurs when an individual intentionally, knowingly, or recklessly:

  • Causes bodily injury to another person
  • Threatens another person with imminent bodily injury
  • Causes physical contact with another that the offender knows or reasonably should know the person will find provocative or offensive

Domestic Violence Penalties

The penalties for a domestic violence conviction can be very severe. A conviction could result in fines, jail time, limitations in child visitation rights, and loss of gun privileges. The type of crime and the number of offenses previously committed determines the penalties imposed.

Possible punishments for domestic violence include:

  • Class C misdemeanor – a fine of up to $500
  • Class B misdemeanor – up to six months in jail and/or a fine up to $2,000
  • Class A misdemeanor – up to one year in jail and/or a fine up to $4,000
  • Third-degree felony – 2 to 10 years in prison and a fine up to $10,000
  • Second-degree felony – 2 to 20 years in prison and a fine up to $10,000
  • First-degree felony – 5 to 99 years in prison and fine up to $10,000

If convicted, another consequence may involve paying restitution to the victim of any expenses that resulted from the act of violence. This could include medical expenses, counseling fees, or expenses related to the repair or replacement of damaged property.
